Healthcare bucket: Lilly MFN carveout in FOIA contracts, CDMO series still missing
Public Citizen FOIA, published Sep 19: Lilly's MFN/TrumpRx contract excludes Mounjaro and Zepbound from certain MFN discounts; similar Novo carveout sized at ~$1.7B Medicaid. Deals run through Jan 20, 2029. Still no 2026 realized mAb fill-finish series. Do not graduate TMO or re-rate LLY.

Filed by the 2026-09-21 stock-market daily routine (headless). Healthcare/demographics is a thin vertical (step 2a). This pass does not invent a 2026 realized CDMO price series.
What is new (Sep 19)
The Washington Post (Dan Diamond / Riley Beggin, September 19, 2026) and Public Citizen's FOIA dump, as recapped by Common Dreams and the Seattle Times, show the Trump administration's confidential MFN / drug-pricing contracts with Pfizer and Eli Lilly include terms that were not in the White House talking points:
- Lilly's agreement excludes Mounjaro and Zepbound from the definition of products subject to certain most-favored-nation discounts. Public Citizen says a similar Novo Nordisk carveout could reduce potential Medicaid savings by $1.7 billion. (WaPo; Common Dreams.)
- Both deals are scheduled to run through January 20, 2029.
- The contracts include tariff protections and language that lets Lilly, under certain circumstances, stop supplying a medicine to another country and thereby remove that nation's price from the US MFN calculation.
- A Lilly spokesperson, in the Seattle Times recap, pointed to expanded access for Zepbound and Foundayo. That is the company's frame, not a volume print. (Seattle Times.)
WaPo itself 403/timed out in this environment; load-bearing quotes are taken from the search extract and from the Common Dreams / Seattle Times recaps of the same FOIA set. Treat the carveout as reported contract text via FOIA, not as a CMS claims print.
What it means for existing theses
- LLY / GLP-1 pricing. The wiki already has MFN / TrumpRx list-price cuts and Foundayo mix. A carveout that keeps the two injectables out of MFN is consistent with "pricing risk is admitted, franchise is protected," not a new forcing function. Do not graduate a new LLY chain. Do not re-rate LLY on a FOIA recap.
- Western CDMO / TMO. Casper's reshoring-CDMO comments (Pharma Manufacturing, already in the TMO mix record) are not this weekend's news. Still no independent 2026 realized mAb fill-finish / CDMO price series. PeptideStaff's 25–40% GLP-1 API CDMO rate range is a consultant note, not a 2026 transaction tape. Step 3 of biosecure-cdmo-scarcity-to-western-cdmo-pricing-power stays
partial. Human call continues. Do not re-date TMO. - PBM / drug-pricing-reform hypothesis. A GOP-administration MFN contract that carves out the highest-volume GLP-1s is not spread-compression evidence for CVS/CI/UNH. Leave drug-pricing-reform-pbm-spread-compression as hypothesis.
What this is not
- Not a BIOSECURE conversion.
- Not a reason to mint a net-new AI-infrastructure chain.
- Not sell-side NII math for Schwab (that is the financials bucket, filed separately as attach).
