Shapiro signed executive order 2026-05 on August 18 (the primary is on pa.gov). Pennsylvania is now the third large US market — after New York and Texas — where a siting gate, the permit that can stop a data center, can halt a project before it is built. The order is not a moratorium. It makes the state's GRID review binding for environmental permits and a tax break once a project is larger than 25 megawatts, tighter than New York's 50-megawatt line. Pennsylvania sits inside PJM, the mid-Atlantic grid. Towns still have to approve first; a second track loses Fast Track. Developers must also add incremental power in the same local grid zone — bring-your-own capacity. New York used an environmental permit, Texas an interconnect audit, Pennsylvania a permit condition plus a local veto: three instruments in 35 days. FERC, the federal electricity regulator, closed comments on docket ER26-3380 on Friday at 17:00 ET and has still not issued an order. The emergency auction window is 09-30 through 10-21, with results on 12-02 and a cap of $555 per megawatt-day. Do not re-rate CEG on a closed comment period.
